Terms of Use

Welcome to FoxFit! These Terms of Use ("Terms") are an agreement between you and FoxFit ("FoxFit", "we", "us", or "our") and govern your use of the FoxFit mobile app and the FoxFit TV web app at https://foxfittv.com (together, the "Service"). Please read them with your child. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who May Use FoxFit

FoxFit is designed for children ages 4–12 to use together with a parent or guardian. Because it is intended for children:

• A parent or legal guardian must set up and supervise the app, including any account, the Friends feature, and any purchases.
• By allowing a child to use FoxFit, you confirm that you are the parent or guardian and that you agree to these Terms on the child's behalf.
• Accounts and purchases must be created and authorized by a parent or guardian.

2. Health and Safety Notice

• The exercises, dances, stretches, breathing activities, and other content in FoxFit are for general fitness and fun, and are not a substitute for professional medical advice, diagnosis, or treatment.
• Consult a doctor before your child begins any new exercise routine, especially if the child has a medical condition, injury, or any concern about physical activity.
• Children should always be supervised by an adult while using FoxFit and while exercising. Make sure there is enough clear, safe space, and stop immediately if the child feels pain, dizziness, or discomfort.
• You use the Service, and allow your child to use it, at your own risk. To the fullest extent permitted by law, we are not responsible for any injury or harm resulting from the exercises or activities in FoxFit.

3. Your License to Use FoxFit

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your family's personal, non-commercial use, subject to these Terms. You agree not to:

• Copy, modify, distribute, sell, or lease any part of the Service or its content;
• Reverse-engineer or attempt to extract the source code, media, or assets, except where the law permits;
• Use the Service in any unlawful way, or in a way that could harm, disable, or overload it, or interfere with any other user;
• Attempt to access the Service or its systems by any means other than the interfaces we provide.

All content in FoxFit — including the fox characters, artwork, videos, music, audio, and software — is owned by FoxFit or our licensors and is protected by intellectual-property laws. These Terms do not give you any ownership of that content.

4. Accounts

Some features (such as Friends and syncing progress across devices) use an account. You are responsible for keeping account credentials secure and for activity that happens under the account. Please tell us right away if you believe an account has been used without permission.

5. Subscriptions, Purchases, and Billing

FoxFit is free to download and offers optional purchases:

• Premium (Fox Club) unlocks premium content and features, and Remove Ads removes advertising. Some content and features are available only with Premium.
• Purchases and subscriptions are sold and processed through Google Play Billing. Payment is charged to your Google Play account when you confirm the purchase.
• Subscriptions renew automatically for the same period and price until you cancel. You can manage or cancel a subscription any time in the Google Play Store; cancellation takes effect at the end of the current billing period.
• Refunds are handled according to the Google Play refund policy and applicable law. Because billing is processed by Google Play, refund requests are generally made through Google Play.
• Prices and available offers may change. Any change to a subscription price will be handled according to Google Play's rules, which generally require notice and your consent before a new price takes effect.

6. FoxFit TV and Pairing

FoxFit TV lets you use the Service in a television browser. To link a TV to the app, you enter a short pairing code or scan it with the app. You are responsible for keeping pairing codes within your household. Pairing codes are temporary and expire. We may change, limit, or discontinue FoxFit TV or any feature at any time.

7. User Conduct and the Friends Feature

If you use the Friends feature, you agree to use it respectfully and only to connect with people your family actually knows. Do not use FoxFit to share content that is unlawful, harmful, or inappropriate, or to harass or harm anyone. We may remove content or limit or suspend access to protect users or the Service.

8. Changes to the Service

We are always improving FoxFit. We may add, change, or remove features, content, or availability at any time, and we may update the app. Some features depend on an internet connection and third-party services that may change.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any content is accurate or complete. Please also read the Health and Safety Notice in Section 2.

10. Limitation of Liability

To the fullest extent permitted by law, FoxFit and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Service. Nothing in these Terms limits any rights you may have that cannot be limited by law, including certain rights of consumers.

11. Termination

You may stop using the Service at any time and uninstall the app. We may suspend or end your access to the Service if you breach these Terms or to protect the Service or its users. Sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

12. Governing Law

These Terms are governed by the applicable laws of the country in which the developer of FoxFit is resident, without regard to conflict-of-laws principles, and without limiting any mandatory consumer-protection rights you have where you live. 13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice in the app or on https://foxfittv.com. By continuing to use the Service after changes take effect, you agree to the updated Terms.
